graduated from the Higher School of Economics (HSE University) and studied in the HSE postgraduate program.

Examples of Cases

Divorce settlement 1

Our firm represented the interests of an expat residing in Russia. His wife petitioned to the court claiming to have rights for a significant part of the family property: a land plot, a house, a car, and money in the bank accounts. On behalf of our client, we filed a counterclaim to exclude part of the property from the common property, to revise how the property has been divided and objections against the wife’s position. The court agreed with our reasoning and decided in favour of our variant.

Divorce settlement 2

We represented the interests of a German citizen. She asked us to prove in the court that her spouse, a Russian citizen, was deliberately trying to transfer the business through a chain of dubious transactions to avoid the assets being divided. The court agreed with our position, deemed the transactions void, and ruled to divide several other assets too.

Contesting paternity 1

We represented our client’s interests and succeeded to prove that he was a biological parent of the child.

Contesting paternity 2

A US citizen asked us to contest his record of paternity in Russian statutory register. We obtained and presented irrefutable evidence to the court and succeeded in protecting his claim.

Restrictions on child’s travelling abroad

The mother filed a claim to restrict her underage daughter from travelling abroad. We represented the father’s interests, a UK citizen, who intended to leave Russia with his daughter. With the help of our lawyers, the father won the case and the restrictions have been released.

FAQ

I am a foreigner. The marriage has been registered outside Russia. May I or my spouse file for a divorce in Russia?

Yes, a Russian court can register your divorce but each case has to be considered separately.

I am a foreign citizen and I am a father. Does this mean that the court will almost always rule for the child to stay with the mother?

The parents have equal rights but in most cases Russian courts would leave the child with their mother. In child arrangement cases the court aims first to find out which primary residence will be most beneficial for the child’s interests. In our practice, we had cases where the child stayed with their father.

The spouse has filed a case in a Russian court on establishing my paternity. I cannot go to Russia now, what can I do?

Your presence in court is not necessary. Your interests can be represented by your solicitor. Usually, such cases involve DNA paternity testing. We can assist you with the procedure of receiving DNA samples from foreign jurisdictions.

I was not aware that I had signed the paternity agreement. Can it be cancelled?

Yes, it can be decided in court as within a contesting paternity case.

How long does it usually take to resolve a family case in court?

Each case is different and the time depends not only on its type but also on specific circumstances, reasoning, and other factors.

On average, the following durations can be used for reference:

  • marriage dissolution – 3-4 months,
  • divorce settlement – 4-6 months,
  • children arrangements – 5-7 months.
